In this Ordinance, unless the context otherwise requires-

PART II ADMINISTRATION

PART III THE REGISTER

The Registrar shall keep a register of ships

The register shall contain such particulars in respect of
ships,

charterers,
gagees and representative persons as are prescribed.
The register may be kept in legible or non-legible form but if
kept in
legible form any entry in the register shall be capable of
being

For the purposes of this section-
there is a material error in the register if there is an error
of fact

without limiting the generality of paragraph (a), there is a

an entry is made in the register without sufficient cause;

there is an error or defect in an entry in the register; and
the reference in paragraph (b) (i) to an entry omitted

ired or permitted by this Ordinance to be entered, or to remain,

register but is not entered in, or is removed from, the register.
The jurisdiction of the High Court under this section may be

Registrar may correct, or cause to be corrected, any clerical

PART IV REGISTRATION OF SHIPS

Registrable ships
Subject to this Ordinance, a ship is registrable if-
a majority interest in the ship is owned by one or more
qualified

the ship is operated under a demise charter by a body corporate

各县、区人民政府,经济技术开发区、长江大桥开发区管委会,市政府各部门、各直属单位,驻芜各单位:
《芜湖市医药分开和药品统一管理工作职责暂行规定》已于2008年7月26日经市政府第6次常务会议审议通过,现印发给你们,请遵照执行。

芜湖市医药分开和药品统一管理工作 职责暂行规定
为认真贯彻落实《芜湖市人民政府关于印发芜湖市医疗机构医药分开和药品统一管理实施方案的通知》(芜政〔2007〕115号)精神,进一步推进芜湖市医药分开和药品统一管理工作,按照医药分开决策权、执行权、监督权相互分离、相互协调的要求,制定本暂行规定。
一、决策机构
芜湖市医疗机构医药分开、药品统一管理工作领导小组(以下简称领导小组)是本市医药分开和药品统一管理的决策机构。领导小组下设芜湖市医药分开工作管理委员会(以下简称管委会),作为领导小组的办事机构,其主要职责:
1.审查芜湖市基本用药目录;
2.审查中标配送企业和生产企业、供货价格;
3.审查专家库专家人选;
4.听取并审议市药品管理中心运行情况的报告;
5.办理领导小组交办的其他事项。
二、执行机构
执行机构主要包括市医疗机构药品管理中心(以下简称市药管中心)、市政府采购代理处、参加医药分开和药品统一管理工作的各医疗机构及纳入医保的社区卫生服务机构。
(一)市药管中心主要职责
1.根据城镇职工和居民基本医疗保险管理部门、新型农村合作医疗管理部门确定的药品目录和医疗机构用药需求、习惯,结合《安徽省医疗机构药品临时采购目录》,汇总各医疗机构药品采购计划,拟订芜湖市基本用药目录,报市卫生行政主管部门;
2.将经审核确定后的芜湖市基本用药目录送市政府采购代理处委托集中采购;
3.建立统一的药品采购供应管理信息系统,有效组织药品采购、配送工作;
4.提供方便快捷的服务,满足参加医药分开和药品统一管理工作的医疗机构临床用药需求,保障用药安全;
5.审核医疗机构申报的临床紧急需求药品并按相关程序采购,同时报管委会和市卫生局、市监察局备案;
6.及时将药品的采购价格、零售价格报市物价局备案;
7.审定评标报告,并根据评标委员会推荐的预中标候选人顺序决定中标人和采购清单;
8.确认中标配送企业,并与中标配送企业签订合同和反商业贿赂责任书,做好配送药品验收工作,制订药品配送企业考核方案,根据合同要约及考核结果进行财务结算;
9.负责市药管中心运行资金和使用经费的财务核算及财产物资管理,建立与财务核算相关的业务台账,建立健全内部管理和控制制度,定期向市财政、审计部门报送财务报表;
10.负责市药管中心及在院药品调配中心人员和业务管理; 11.定期向管委会报告工作,完成管委会交办的其他事项。
(二)市政府采购代理处主要职责
1.接受市药管中心的委托,依法组织招标、开标、评标,确定药品品种、规格、生产厂家、供货价格和药品配送企业,并将相关结果书面报管委会;
2.对管委会及各方当事人提出的质询意见按《中华人民共和国政府采购法》及相关规定予以书面答复。
(三)参加医药分开和药品统一管理工作的医疗机构主要职责
1.根据临床需求、用药习惯及最大限度降低患者药品费用支出的基本原则,编制年度基本用药计划,经本单位药事管理委员会集体审核后报市药管中心;
2.严格按照芜湖市医疗机构基本用药目录用药,加强医院临床药事管理,建立医务人员用药考核制度,严禁擅自采购药品和临床药品促销活动;
3.按程序办理芜湖市基本用药目录以外的特殊临时用药;
4.按规定将药品零售价格在服务场所显著位置予以公示;
5.配合市药管中心对在院药品调配中心人员进行日常管理和考核;
6.按时与市药管中心进行核算和财务结算;
7.无偿提供在院药品调配中心工作所需场所和配套设施条件;
8.按照基本医疗保险规定为参保人员就医提供优质服务;
9.建立健全绩效考核管理机制。
(四)纳入医保的社区卫生服务机构主要职责
1.严格按照社区卫生服务机构用药参考目录用药,加强用药管理,严禁临床药品促销活动;
2.按照基本医疗保险规定为参保人员就医提供优质服务;
3.按时与中标配送企业进行核算和财务结算;
4.建立健全绩效考核管理机制。
三、监督机构
芜湖市医药分开工作监督委员会(以下简称监委会)由市监察局牵头,市卫生局、药监局、劳动保障局、物价局、审计局等部门参加,对芜湖市医疗机构医药分开和药品统一管理工作依据各自职责进行全程监督。
(一)市监察局主要职责
1.组织监委会成员单位对医药分开和药品统一管理工作进行专项检查督察;
2.派出医药分开和药品统一管理监督组,对药管中心采购配送工作实施全程监督;
3.检查有关单位和部门在遵守和执行法律、法规以及相关规定中的问题;
4.会同相关单位、部门,设立举报电话和举报箱,接受社会监督,受理对药品集中采购事项的举报;
5.调查处理在医药分开和药品统一管理工作中有关行政机关及其公务员和国家机关任命的其他人员违反行政纪律的行为。
(二)市卫生局主要职责
1.会同市监察局对医药分开和药品统一管理工作进行专项检查督察;
2.按照相关规定遴选评标专家,建立评标专家库,并会同市招标采购交易中心管理委员会办公室共同管理评标专家库;
3.会同市药监局组织专家对市药管中心汇总的芜湖市基本用药目录进行审定,并报管委会审查后予以公告;
4.制定并实施医疗机构临床用药考核方案和奖励办法;会同市财政局根据考核结果确定对医疗机构的拨付数额;
5.依法对医疗机构违反规定擅自采购、销售药品及规避使用招标采购药品的行为进行查处;
6.负责药品“收支两条线”管理,会同市财政局考核、分配药品收支节余;
7.以“人随项目走”方式,向市招标采购交易中心派驻“行政执法授权人”,履行对市医疗机构药品集中采购过程的行政监督;
8.受理药品集中采购供应商的投诉事项,并依法提出处理意见。
(三)市食品药品监督局主要职责
1.对市药管中心及其在院药品调配中心、相关药品生产、经营(配送)企业进行监督检查,保证药品质量,保障用药安全;
2.对投标人的资格进行审查;
3.对中标药品进行监督抽检;
4.对不符合药品质量要求、从非法渠道购进药品等违法违规行为依法实施处罚;
5.对在院药品调配中心“规范药房”建设进行监督、指导。
(四)市劳动和社会保障局主要职责
1.向管委会、市药管中心、医保定点医疗机构提供医保用药目录;
2.对医保定点医疗机构医保人员用药情况进行监督;
3.对符合基本医疗保险支付范围内的医疗费用与定点医疗机构、定点零售药房药店及时进行结算;
4.按规定确定基本医疗保险定点药房药店,并依法加大监督检查力度;
5.制定加强参保人员住院监管办法并组织实施。
(五)市物价局主要职责
1.将审核确定的药品零售价格在市物价局网站公示;
2.监督检查药品价格政策执行情况;
3.依法查处医药分开和药品统一管理过程中的价格违法行为。
(六)市审计局主要职责
1.对医疗机构、市医保中心、市药管中心的财务收支情况进行审计监督,对实施医药分开和药品统一管理工作相关部门进行审计调查,确保财务收支和资金运行的真实、合法、效益和安全;
2.对截留、挪用药品购销资金等违反财经纪律的行为依法查处。
四、其他相关部门
(一)市财政局主要职责
1.负责对开展医药分开和药品统一管理工作政府性资金财政预算安排,实行药品“收支两条线”管理;
2.对市药管中心执行“收支两条线”情况进行监督;
3.配合市卫生局做好药品收支节余的考核、分配工作。
(二)市人事局主要职责
1.会同市财政局、卫生局制定参加医药分开和药品统一管理工作的医疗机构工资总量核定办法,指导参加医药分开和药品统一管理工作的医疗机构做好绩效考核、收入分配工作;
2.会同市卫生局依照《芜湖市人民政府办公室关于印发芜湖市事业单位实行聘用合同制管理办法的通知》(芜政办〔2007〕70号)及有关规定,对违反医药分开和药品统一管理规定的工作人员的处理情况进行监督、检查,受理人事仲裁。
(三)市招标采购交易中心管理委员会办公室主要职责
1.制定芜湖市医疗机构药品集中采购管理办法和实施细则,编制药品集中采购流程;
2.负责市药品招标采购评标专家库的日常管理和考核,按规定在市药品招标采购评标专家库中随机抽取评标专家,实行“双密码”管理。
(四)市政府法制办公室主要职责
1.审查涉及医药分开和药品统一管理工作的规范性文件;
2.提供涉及医药分开和药品统一管理工作的法律咨询服务。
各相关单位、部门应当根据各自承担的主要职责,制定实施细则或实施方案,报市政府备案。市政府督办室不定期对相关单位、部门履职及工作情况实施督查并予通报。
